INTRODUCTION
After independence, India becomes a sovereign state and sovereignty lies with the people of India as the Preamble of the Constitution emanated from them. Unlike British Parliament, Indian Parliament cannot claim unlimited powers. Now it seemed that the right of the citizens to criticise the government is superior to the right of the government to protect itself against sedition. The offence of sedition is also outside the scope of the international standards which limits the freedom of expression. Law of sedition developed in the era of monarchy and today it violates the very purpose of democratic system of government.
